Certificate of Occupancy / Transfer of Title / Smoke Detector – Carbon Monoxide Certificates / Well Water Certifications. In most real estate transactions, the seller is responsible for complying with the municipality and obtaining any necessary code certifications for the transfer of the property. Please make arrangements to contact your municipality and schedule any inspections in order to obtain the proper certifications. These certifications must be secured from the municipality and presented to the Buyer prior to closing.
Pursuant to N.J.S.A. 58:12A-26, et seq. and the accompanying regulations under N.J.A.C. 7:9E, et seq., as a condition of sale of real property for which the potable water supply is (1) a private well located on the property, or (2) a well that has less than fifteen (15) service connections or that does not regularly serve an average of at least twenty-five (25) individuals daily at least sixty (60) days out of the year, such water’s supply shall be tested in accordance with the provisions of the Act. Seller shall at seller’s sole cost and expense, conduct all such water tests in accordance with the Act. Seller shall provide a copy of all such water test results to Buyer(s) within ten (10) calendar days of this contract. Closing of title on the sale of the real property shall not occur unless both the Buyer and Seller have received and reviewed a copy of the water test results.

Closing. Our office will prepare the necessary documents for you to sign to convey title to the buyer at the time of closing. Your presence at the closing is requested but is not necessary. You may sign the closing in advance at our office.
